Documents Needed From Debtors

Debtor(s) must provide copies of the following documents (where applicable) to Mr. Carr prior to the preparation of their bankruptcy petition, preferably at or before the initial meeting to the extent possible. NO ORIGINALS PLEASE. Please include reverse sides. PDF or floppy disk is PREFERRED. To defray costs, we charge 25 cents per page for hard copy paper handling, including faxes, copying, and printing after the first 30 pages in any one case.

  1. 6 months of paycheck stubs/advices. Current year annuity distribution, Social Security, unemployment compensation, welfare and pension award letters, partnership and S corporation distributions, etc. If self-employed, it is also necessary to provide your business profit and loss statements for the last 12 months. This should include evidence of earnings from eBay, Craigslist, wagering, side jobs, etc. 
  2. 6 months of bank account statements that verify the income provided on the paycheck stubs, or social security and pension deposits, etc.
  3. Copies of titles to all motor vehicles and all other property which is titled by law in the state(s) in which it is held, i.e. motor homes, boats, aircraft, etc.
  4. If debtor(s) own real property (including partial and/or contingent interests): recorded mortgage and deed for all real property, including timeshares, condos, vacation and investment property. These documents are normally obtained from the Recorder's Office for the county where the real property is located. Also include any applications for mortgage modifications filed within the past 6 months.
  5. Copies of any and all lease agreements with third parties, including motor vehicle leases, furniture rentals, lease with option to purchase/rent-to-own property, cell phone contracts, etc.
  6. A copy of appraisals made within the past 12 months for all real property owned by the debtor(s), including vacation home, rental property. For any real property which has not been appraised within the past 12 months, unless otherwise instructed by Mr. Carr, you are responsible for obtaining a current market value appraisal from a licensed real estate appraiser or Realtor, as applicable, at your cost prior to filing bankruptcy. A full appraisal is not appropriate for this purpose and is more costly. What is needed is a “drive by appraisal” that accurately reflects the current market value for your bankruptcy filing. (A/K/A a “market value” appraisal.) Prices for this service are typically variable so you should shop around to get a good price.
  7. Copies of all lawsuits, foreclosures, judgments, liens or garnishments filed by or against the debtor(s) within the past two (2) years.
  8. Copies of all insurance policies including life, disability insurance, homeowners, renters, motor vehicles, marine, motorcycle, mobile home. Include any "riders" which cover any specific items of personal property with insured values.
  9. Income tax returns for the past two (2) years (IRS and State with all schedules, W-2s and 1040’s).
  10. All documents relating to retirement accounts, pensions and annuities, IRAs, 401Ks, etc. Do not include prospectus, 10K materials, etc.
  11. Separation agreements, decrees of dissolution, divorce decrees or support obligations filed within the past one (1) year.
  12. Security agreements, financing statements and any or all personal property leases.
  13. Copies of current credit reports from all 3 credit reporting agencies: Equifax, TransUnion and Experian. Under law, the debtor(s) are entitled to one free credit report per year which they can obtain online at the websites maintained by each credit union. Commercial providers may advertise that they provide such reports for free but there is usually a “hook” into a paid service for which they will maintain your credit card number on file and start billing same after a trial Period (usually 30 days). You should not be using a credit card during or immediately preceding your bankruptcy. Debit cards are OK to use.
  14. Stock certificates, bonds, credit union and passbook savings accounts and statements evidencing investments or savings.
  15. Documents verifying in any future interest (such as under the will or trust of another person)
  16. Consumer credit counseling certificate. If the debtor(s) have not yet obtained credit counseling, there are several places to obtain them online. Maximum cost is $50 for which you are responsible. Two that we can recommend:

  21. Copies of discharges granted or court papers regarding other disposition of any previous bankruptcy cases filed within the past eight (8) years.
  22. Copies of the most recent statement from any educational IRS and/or Tuition Trust account.
  23. Copies of the most recent statements from any student loans.
  24. List of prior addresses the debtor(s) have lived at within the past three (3) years.
  25. Copies of all utility bills for the past six (6) months.
  26. Driver's license or state identification card which provides verification of debtor(s) social security number.
  27. Documents relating to debtor(s)’ "disabled veteran" status, if applicable.
  28. Copies of all tax assessments, preliminary statements and bills from all taxing authorities, including excise and property tax paid and/or payable even if not yet due for the past 2 years unless escrowed in which case please provide escrow account records for the same period. 
  29. Copies of all other current bills and statements from all creditors, including a current mortgage statement. 
  30. Lists, appraisals and inventories of any other valuable items held by or for the debtor(s) such as artwork collections, coins, stamp collections, rare books, furs, gems and jewelry, antiques, and collectables/memorabilia whether or not held for sale. 
  31. Payment in good funds for the entire fee charged by Mr. Carr as agreed plus the applicable filing fee ($313 for a Chapter 13 or $338 for a Chapter 7) both must be remitted By check or debit card PRIOR to filing of your petition. NO EXCEPTIONS.
  32. You must complete and bring to the initial meeting our 4 page   Initial Intake Form  (requiring mostly “Yes” or “No” answers) which will shortly be sent to you separately via email.
